Terms and Conditions

For the Datey iOS app · Last updated October 16, 2026

This document is currently available in English.

Privacy PolicyTerms and Conditions

1. Our agreement

These Terms govern your use of Datey and its Single and Couples features. The provider is Tortuga Global Tech LLC, 1021 E Lincolnway, Suite 10348, Cheyenne, WY 82001, United States. Contact support@tortugatech.co.

You must be at least 18 years old and legally able to enter this agreement. Each connected partner uses Datey under their own agreement with us; paying for a partner does not let you accept terms or give privacy consent on their behalf.

Please review these Terms before accepting them in the app. If you do not agree, do not proceed with use. Our Privacy Policy explains processing of personal information; accepting these Terms does not replace a separate consent required by privacy law.

Your App Store license for Datey is governed by Apple's Standard End User License Agreement, with Tortuga as the application provider. These Terms add Datey-specific conditions for purchases, partner access, sharing and support; they are not a custom EULA and do not replace the Standard EULA. Where their scopes overlap, read them consistently. If there is a conflict on a matter governed by the Standard EULA, that agreement controls, subject to mandatory law.

2. What Datey provides

Single features help you record people, dates, notes and memories and view maps, spending and personal insights. Couples features help you record relationship activities, create collections and custom lists, plan, keep special dates, share selected types of information, answer check-ins and play conversation games.

Using Couples mode does not itself connect another person's phone. Supported features can be used without pairing, subject to purchase requirements. Monogamous mode selects one partner; the partner entitlement described below covers one connected partner.

Title suggestions and maps depend on external services and may be incomplete, inaccurate or unavailable. Search-enabled title fields can contact a catalog service before an entry is saved, as explained in Privacy section 3.6. A suggestion is not our endorsement of its subject or a guarantee of availability.

Datey does not find or verify dating matches. It does not verify a partner's identity, assess relationship safety or provide medical, psychological, legal or other professional advice. Insights and game results depend on the information entered and are for personal reflection. They are not diagnoses or a reliable assessment of another person's character, compatibility or consent.

Features, compatibility and purchases available to you may depend on your app version, device, region and the offer shown before purchase. These Terms do not override a specific benefit or mandatory right already included in your purchase.

3. License and permitted use

The Standard EULA governs your app license. Datey's connected-partner entitlement is separate from Apple's Family Sharing and does not transfer the purchaser's license, purchase ownership or Apple Account to their partner.

You may not resell or sublicense the app, bypass purchase or access controls, misuse invitation codes, obtain unauthorized access to another person's information, or reverse-engineer the app except where applicable law or an open-source license permits it. Open-source components remain subject to their own licenses.

We retain rights in Datey's software, branding and original interface. You retain your rights in your own content. You authorize only the storage, synchronization and disclosure needed to carry out the features and sharing choices you use, subject to applicable law and the Privacy Policy. This is not a license for us to publish your journal for advertising.

4. Subscriptions, Lifetime and partner access

4.1 Offers and payment

The available plans, total price, billing period, trial conditions and included features are shown before purchase. Apple processes payment using your App Store account. Monthly and yearly subscriptions renew automatically unless canceled. A Lifetime offer, where available, is a non-recurring purchase, not an auto-renewing subscription.

4.2 Connected-partner access

An active monthly or yearly subscription, or a Lifetime purchase, allows the purchaser and one connected partner to use the included couple features without that partner buying a second plan. The same connection rule applies to existing Lifetime purchases. Both people need compatible devices and iCloud access for the connection. A pairing code alone is not a purchase or proof of an active entitlement.

The purchaser controls their purchase through Apple. Their partner receives access through the connection; this does not transfer ownership of the purchase or permit changes to the purchaser's billing. Restoring purchases on a partner's different Apple Account does not restore a purchase that account never made.

While the partners remain connected, either person's qualifying active plan is sufficient for their included couple access. If you disconnect and have no qualifying purchase of your own, your partner-provided access ends; you need your own qualifying purchase to continue using Datey independently under your own qualifying plan. The purchaser retains access under their own purchase. Shared access also depends on a qualifying entitlement remaining active; canceling renewal does not by itself mean the current paid period has already expired.

Datey retains journal data on lapse rather than intentionally deleting it merely because paid access ends, but retained data does not mean all app functions remain available. Contact support for help with access or privacy requests.

The shared couple entitlement applies while you use Couples mode. Switching to Single mode removes that shared access from the current app session; your own qualifying purchase remains separate. Returning to Couples mode requires a still-valid shared entitlement or your own qualifying purchase for paid features.

Leaving, changing mode, disconnecting a partner, ending a relationship or deleting the app does not cancel an Apple subscription. If both people bought subscriptions, connecting does not automatically cancel or refund either one. Each purchaser should review their own Apple subscriptions.

4.3 Renewal, trials and cancellation

Apple may charge for renewal within 24 hours before the current period ends. To avoid a renewal, cancel before the applicable renewal deadline shown by Apple. For a free or discounted trial, Apple instructs users to cancel at least 24 hours before it ends if they do not want it to renew. Eligibility and duration depend on the actual offer and Apple's purchase confirmation.

Manage or cancel through Settings → your Apple Account → Subscriptions → Datey. Cancellation normally stops the next renewal; access to a paid period normally continues until its end. A trial may end earlier on cancellation under its offer terms. See Apple's cancellation instructions.

Apple provides notice of subscription price changes. Some increases require your express acceptance and some may proceed after notice where Apple's rules and applicable law allow it. You can cancel if you do not want to continue. We do not promise that Apple seeks express consent for every price increase. See Apple's price-change guidance.

4.4 Lifetime and restoration

A Lifetime purchase grants non-expiring access to the features included in the purchased offer while Datey remains available on a supported platform, subject to your purchase terms and mandatory rights. It is not a guarantee that Apple hardware, iCloud or the app will exist or remain compatible forever. We will not use this wording to remove benefits already promised to an existing purchaser.

Lifetime belongs to the purchaser. It does not give a connected partner a separate permanent entitlement. If the connection ends, a partner without their own qualifying purchase must obtain one to continue using Datey independently, even if the former partner owns Lifetime.

Use Restore Purchases with the Apple Account that made the purchase. Partner access depends on restoring or maintaining the sharing connection and the eligible entitlement. Synchronization and entitlement refresh can be delayed by connectivity or platform availability.

5. Refunds and consumer rights

For an App Store purchase, request a refund through Apple's Report a Problem service. Contact us if you need assistance. Refund eligibility depends on Apple's process and applicable law; nothing here removes statutory remedies.

Where consumer law provides cancellation, withdrawal, conformity, repair, replacement, refund or other rights, those rights prevail over inconsistent wording in these Terms. Merely downloading or using Datey is not stated to waive a statutory withdrawal right. A waiver for immediate delivery of digital content is effective only where the required information, express consent and acknowledgment have actually been obtained.

6. Pairing and sharing

Choose your connected partner carefully. Invitation names are user-supplied, not verified identities. Keep codes and links private and check the intended person before approving or accepting a connection.

Shared features can transmit existing and new information associated with that relationship: activities, collections, custom lists and bucket-list items, shared notes and ratings, photos, trips and saved places, special dates, shared intimacy entries, check-ins, messages, availability, game answers and guesses. Relationship settings, some self-profile details and access-status information also cross the connection. The Privacy Policy explains the distinction between shared entries and private journal notes and ratings.

A connected partner can receive and retain local copies and can edit or delete shared library entries. Their changes may affect the shared library on your device. Partner sharing requires network access and Apple services; it is not guaranteed to be immediate or continuously available.

Disconnecting ends the sharing connection when cloud revocation completes. It does not guarantee removal of data already received, copied, backed up, exported or captured by the other person. If the app reports pending or failed cloud revocation, reconnect and follow its retry instructions. Changing an app mode or uninstalling is not a substitute for disconnecting.

Switching to Single mode while staying together pauses outgoing couple publication while that mode is active but keeps the underlying connection. It does not permanently exclude every entry created in that mode from future sharing. Ending the relationship starts disconnection and clears some couple state while retaining journal history; it is not a full-data deletion command. After a reinstall, Datey may find an existing cloud connection and offer restoration. Declining or postponing that offer does not itself revoke the connection. Privacy section 7 explains these differences.

These limits do not authorize a recipient to retain or disclose information unlawfully and do not waive any person's data-protection rights. Privacy requests to Tortuga are assessed under the Privacy Policy and applicable law, including any duty to notify recipients or providers of a deletion request.

Only share information you are entitled to share. Do not coerce someone into connecting or disclosing intimate information. An answer about sex drive, a game response or a past intimacy entry is not consent to sexual activity or to future disclosure of that person's information.

7. Storage, backup and deletion

Your content is stored on your device, in enabled Apple storage services, and on connected recipients' devices where shared. We do not maintain a general-purpose recovery copy of your private journal. Keep backups appropriate to your needs and check that they completed successfully.

Personal sync, Datey's encrypted backup, Apple's device backup and partner sharing are distinct. Turning one off does not necessarily disable the others or remove existing copies. The Privacy Policy describes defaults and limitations.

PrivateVault files are excluded from Datey sync and backup and use a device-bound key. Do not assume they can be restored after device loss, reset or reinstall. If you export a copy, protect its new location separately.

Use the app's deletion controls to request deletion from the storage they cover. Cloud deletion requires access to the correct Apple Account and can fail or remain pending. Deletion cannot erase independent copies held by other people or copies exported to other services. Apple's separate billing records and purchases are not removed by deleting Datey data.

You are responsible for reasonable care of your device, account and copies. That responsibility does not exclude our liability for a failure for which applicable law makes us responsible.

8. Responsible use and reports

You must not use Datey to:

  • Create, obtain, store or distribute unlawful material, including child sexual abuse material or sexual imagery involving minors.
  • Store or disclose intimate images without the person's required consent or legal authority.
  • Stalk, harass, threaten, exploit, impersonate or unlawfully monitor someone.
  • Access another person's device, journal or sharing connection without authorization.
  • Record information about minors, infringe others' rights, or use sharing to evade a person's withdrawal or disconnection.

Private content is not routinely reviewed by us, and we cannot necessarily access or remove a journal or a recipient's copy. Report misuse to support@tortugatech.co without sending unlawful images or unnecessary intimate material. We can assess reports, explain controls and take actions available to us and required by law. Do not rely on Datey support as an emergency service.

You are responsible for lawful entries and disclosures you make. These Terms do not declare every personal diarist a legal “controller” or absolve Tortuga of its own data-protection responsibilities.

9. Availability and updates

We may release updates to improve Datey, address security issues and maintain compatibility. We may change features where permitted by law, while respecting existing purchase promises and applicable digital-content rights. We will provide any legally required notice, remedy or opportunity to end the agreement for a material adverse change.

Apple services, network conditions, storage limits and device settings may affect synchronization, notifications, recovery and purchases. We cannot guarantee continuous access or error-free operation. These limitations do not remove duties or remedies that applicable law imposes on us.

10. Warranties and liability

The Standard EULA contains warranty and liability provisions for matters within its scope. These additional Datey Terms do not create a separate monetary liability cap. Any applicable non-waivable rights remain protected.

To the extent the law permits, Datey is provided as available without additional promises that it will meet every personal purpose or be uninterrupted. Mandatory warranties, conformity obligations, reasonable-care duties and consumer remedies remain in force.

We are not responsible for another person's independent behavior merely because you recorded or connected with them in Datey. This does not excuse a breach of our own obligations. Data loss or exposure can result from device loss, unauthorized account access, failed synchronization, deletion, exports or a recipient's actions; our liability for any particular event remains subject to applicable law.

No term excludes or limits liability where doing so is unlawful, including applicable statutory consumer rights and liability that cannot be excluded for fraud, intentional misconduct or death/personal injury caused by negligence. Consumers retain the protection of mandatory local law despite any contractual choice of law.

11. Ending use

You can stop using Datey. Separately review your subscription, partner connection, cloud copies and backups using sections 4, 6 and 7. Uninstalling is not a request to cancel a subscription or delete information held by providers.

We may take proportionate steps permitted by law if you materially misuse Datey, including restricting access to Datey services where justified and consistent with the Standard EULA. We will give notice and an opportunity to address a breach where required. We do not promise a remote capability to erase or disable a local private journal that we do not have.

Terms concerning ownership, accrued payments, statutory rights, lawful use, liability and resolution of existing disputes continue to the extent their nature requires. Ending use does not authorize new processing of your information.

12. Changes to these Terms

We will identify a new version and effective date when changing these Terms and provide notice and acceptance choices as required for material changes. New terms do not silently rewrite an existing dispute or remove non-waivable rights. A privacy notice update is not a substitute for consent to a new sensitive-data use.

13. Applicable law and resolving concerns

If you have a concern, contact support@tortugatech.co so we can try to resolve it. Contacting support is not a condition for bringing a claim, obtaining urgent relief or exercising statutory rights, and does not extend a legal deadline.

The Standard EULA remains applicable according to its scope. These additional Datey Terms do not add a separate arbitration requirement, class-action waiver, shortened claim deadline or exclusive court selection. Mandatory local laws and any non-waivable right to bring a claim before a competent court remain unaffected.

14. App Store and support

Tortuga provides Datey support at support@tortugatech.co. Apple administers App Store billing and its purchase/refund processes. Use section 4 for subscription management and section 5 for refund requests. The Standard EULA remains the app license; this section does not create an additional custom license or change mandatory consumer rights.

15. General terms and contact

If a term cannot lawfully apply, it is limited or removed to the extent necessary without defeating mandatory protections. A failure to enforce a term on one occasion is not a general waiver. These Terms, the specific offer accepted at purchase and the Standard EULA apply according to their scopes and section 1; mandatory law prevails over inconsistent wording.

Translations should communicate the same rights and obligations. Any English-language priority rule is subject to mandatory local-language and consumer requirements.
